Due to an unexpected serious illness I returned to the UK four weeks later than expected
and found in my post a letter from the Council which said:
My records show that you have not made payment as required. Please pay the TOTAL
OUTSTANDING in full within the next 7 DAYS, otherwise legal proceedings will commence
without any further notice
IF YOU WERE PREVIOUSLY DUE TO PAY BY MONTHLY INSTALMENTS, YOUR RIGHT TO DO SO HAS
NOW BEEN LOST
UNLESS YOU PAY THE TOTAL OUTSTANDING OF £ 640.00 AS REQUESTED, YOU WILL BE ISSUED
WITH A SUMMONS AND WILL INCUR ADDITIONAL COSTS OF AT LEAST £84.00. CONTINUED NON-PAYMENT
MAY RESULT IN YOUR ACCOUNT BEING PASSED TO THE BAILIFFS.
I panicked as I did not have £640.00 spare cash having only just returned from abroad
so I went online and paid them £384.00 which was the three instalments due up to
the 28th November 2013, followed by another payment of £128.00 two days later and
the final instalment on the 31st October 2013 after I had collected my rather meagre
state pension. This cleared my outstanding Council Tax for the year 01-Apr-2013 to
Imagine my surprise when this was rewarded by the Council with a letter dated 31st
October 2013 which showed an outstanding amount of £ 212.00 and which included costs
of £84.00. I just had bent over backwards to pay them the rates which I could ill
afford and they charge me £84.00 in costs which, so they said, included court costs
The council letter was headed
SUMMONS FOR THE NON-PAYMENT OF COUNCIL TAX IN THE METROPOLITAN BOROUGH OF DUDLEY
Complaint has been made to me by Dudley Metropolitan Borough Council that you, being
a person liable for council tax, have not paid the amount below.
YOU ARE THEREFORE SUMMONED to appear before the Magistrates sitting at MAGISTRATES
COURT, THE INHEDGE, DUDLEY at 09.30 on Thursday 28th November 2013. If you do not
appear you will be proceeded against you as if you had appeared and be dealt with
according to the law.
So here I was
I was 16 days overdue with my council tax and I was being hounded and intimidated
by Dudley Council in a manner normally used by loan sharks and back street lenders
which can only be described as heavy handed bullying when a simple reminder would
have solved this matter amicably. Some vulnerable older people might get seriously
upset when they are told that they have to find the funds to pay the full amount
of Council Tax, especially in the run up to Christmas and the beginning of the winter
and when they are threatened with a court appearance and the bailiffs if they don’t
I have now written to the Council and have told them if they ever do that to me again
then I will simply claim that I am unable to pay and I will offer them a weekly payment
for as long as it takes to pay the Council Tax as I consider their action to be vicious,
callous and insensitive. To write threatening letters and issue fictitious ‘summons’
to rate payers who have never defaulted and who have always paid upon receipt of
a reminder is an affront and an insult.
I have also requested an explanation how they can justify to charge an amount of
£84.00 for a piece of pre-printed paper purporting to be sent by the Court when,
according to the ‘summons’, the actual court costs are supposed to be a mere £3.00.
This is clearly profiteering from the misery and wretchedness caused by requesting
the full amount of Council Tax from OAP’s who struggle to pay their weekly bills.
Finally I am more than happy to attend the MAGISTRATES COURT on the 28th November
2013 at 09.30 and I have told them that I will be there to explain the situation
and that I will only pay their ‘costs’ of £84.00 if ordered to do so by a Court
DUDLEY MBC SHOULD BE THOROUGHLY ASHAMED FOR BEHAVING IN SUCH A MENACING AND INTIMIDATING
WAY THREATENING LAW ABIDING RATE PAYERS WITH COURT APPEARANCES AND BAILIFFS AND,
IN ADDITION, CHARGING EXTORTIONATE FEES FOR FICTITIOUS AND PREPRINTED SUMMONS
BUT WHAT ELSE CAN YOU EXPECT WHEN A COUNCIL IS RUN BY LAWYERS

It’s now over TWO WEEKS that I wrote that letter and you guessed right, the Council
has not had the common courtesy to respond.
They clearly work on the principle that they can do what they like and can treat
the rate payers in Dudley like a piece of dirt.
9 days from now is my date in Court and I will be there, I just hope they will attend
Dudley Council have now responded and informed me that they have withdrawn the Court
Summons. What a shame, I really looked forward to attend the Court and have my say.
In their response they are saying that if you are unable to pay then you should contact
their their Recovery Section and they would do their best to assist.
What is the point of that ?
All they had to do send me another reminder and I would have made my payments up
to date as I always have done before. But this would be to simple for them and they
clearly prefer to create more work so that they can employ even more staff which
is paid by the rate payers.
According to a recent article in the media 25% of the money paid to the Councils
goes straight into the pension pot of their employees so that they can retire on
FINAL SALARY PENSIONS whilst the employees in the private sector, who are the ones
who create the wealth of a country, have to make do with a STATE PENSION which is
below the level of most other countries in the EU.
But then, NONE of the people who work in the PUBLIC SECTOR care about that as they
simply use the money other people earn for them.
THEY ARE TOTALLY NON-PRODUCTIVE AND GOT NO IDEA WHEN IT COMES TO MANAGING RESOURCES
WHICH HAVE TO BE EARNED FIRST BEFORE ANY MONEY CAN BE SPENT
